Welcome to Twiggs Martial Arts Academy (“the Academy,” “we,” “us,” or “our”). By enrolling in classes, participating in events, or using our facilities, services, or website (collectively, the “Services”), you agree to be bound by the following Terms and Conditions (“Terms”). 2. Membership and Enrollment
2.1 Eligibility: Membership and participation in classes are open to individuals who meet the Academy’s requirements, including but not limited to age, health, and behavioral standards. Minors (under 18) must have a parent or legal guardian sign all necessary agreements, including these Terms and a Liability Waiver.
2.2 Registration: To participate in classes or programs, you must complete the registration process, which may include providing accurate personal information, signing a Liability Waiver, and agreeing to these Terms.
2.3 Membership Plans: Membership plans, pricing, and schedules are subject to change at the Academy’s discretion. Details of available plans are provided at the time of registration or on our website.
2.4 Payment: All fees (e.g., membership dues, class fees, equipment purchases, or event fees) must be paid in full at the time of registration or as outlined in your membership agreement. Payments are non-refundable unless otherwise stated in these Terms or required by law.
2.5 Automatic Billing: If you enroll in a recurring membership plan, you authorize Twiggs Martial Arts Academy to charge your designated payment method automatically. You must notify us in writing at least 30 days in advance to cancel automatic billing.
3. Code of Conduct
3.1 Respectful Behavior: All students, parents, guardians, and guests must act respectfully toward instructors, staff, and other students. Disruptive, abusive, or unsafe behavior may result in immediate termination of membership or removal from the premises without refund.
3.2 Facility Rules: You agree to follow all Academy rules, including but not limited to dress code (e.g., proper martial arts uniform), hygiene, and safety protocols. Failure to comply may result in suspension or termination of membership.
3.3 Prohibited Activities: Weapons, drugs, alcohol, smoking, or any illegal activities are strictly prohibited on Academy premises.
4. Health and Safety
4.1 Physical Condition: By participating in our programs, you represent that you (or your minor child) are in good physical health and capable of engaging in martial arts training. You must disclose any medical conditions, injuries, or limitations to the Academy prior to participation.
4.2 Assumption of Risk: Martial arts training involves physical activity and inherent risks, including but not limited to injury, muscle strain, or aggravation of pre-existing conditions. By participating, you acknowledge and accept these risks.
4.3 Liability Waiver: All participants (or their parent/guardian, if a minor) must sign a Liability Waiver releasing Twiggs Martial Arts Academy, its owners, instructors, and staff from liability for injuries or damages sustained during participation, except as caused by gross negligence or willful misconduct.
4.4 Emergency Medical Treatment: In the event of an emergency, you authorize the Academy to seek medical treatment on your behalf (or your minor child’s behalf) if you are unable to provide consent.
5. Cancellations and Refunds
5.1 Membership Cancellation: You may cancel your membership by providing written notice to the Academy at least 30 days in advance. Cancellations must be submitted in person or via email to [insert Academy email address]. Verbal cancellations will not be accepted.
5.2 Refunds: Membership fees, class fees, and other payments are non-refundable, except as required by Florida law or at the Academy’s sole discretion (e.g., in cases of serious injury or relocation).
5.3 Class Cancellations: The Academy reserves the right to cancel or reschedule classes, events, or programs due to insufficient enrollment, instructor availability, or other unforeseen circumstances. In such cases, we will make reasonable efforts to notify participants and provide alternative options or credits.
6. Intellectual Property
6.1 Academy Materials: All training materials, logos, videos, and content provided by Twiggs Martial Arts Academy are the intellectual property of the Academy. You may not reproduce, distribute, or use these materials without prior written consent.
6.2 Media Consent: By participating in classes or events, you grant the Academy permission to use photographs, videos, or other media featuring you (or your minor child) for promotional purposes, unless you provide written notice opting out.
7. Privacy
7.1 Personal Information: We collect personal information (e.g., name, contact details, payment information) as part of the registration process. This information is used to manage your membership, communicate with you, and ensure the safety of our programs. We will not share your information with third parties, except as required by law or to fulfill our Services.

8. Termination
The Academy reserves the right to terminate your membership or participation at any time for violation of these Terms, non-payment, or behavior deemed detrimental to the Academy’s community or operations. Termination may result in forfeiture of any prepaid fees, subject to applicable law.
9. Limitation of Liability
To the fullest extent permitted by law, Twiggs Martial Arts Academy, its owners, instructors, and staff shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in our programs or use of our Services. Our liability for any claim shall not exceed the amount paid by you for the Services.
10. Governing Law and Dispute Resolution
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
10.2 Dispute Resolution: Any disputes arising under these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to mediation in Fort Lauderdale, Florida. If mediation fails, disputes shall be resolved in a court of competent jurisdiction in Broward County, Florida.
